These terms govern the use of Zorino, a business application operated by Elixor Online. By creating an account or using the service, you accept them on behalf of your business.
Authorized use
The application is intended for managing a business's contacts and outbound calling campaigns. It is reserved for the authorized members of each customer's team and limited to professional use. Any unauthorized use, attempted fraudulent access, or use contrary to applicable laws is prohibited.
Compliance with calling laws
Each customer is solely responsible for complying with the calling, texting and consent rules that apply to its business and its contacts, including the TCPA in the United States and the CRTC Unsolicited Telecommunications Rules and National Do Not Call List in Canada. Zorino provides tools such as calling hours and a Do Not Call list, but does not verify your compliance.
Twilio account
You connect your own Twilio account. Call minutes, phone numbers and messages are billed by Twilio directly to you under Twilio's terms. Zorino is not affiliated with Twilio and is not responsible for Twilio's pricing, availability or decisions about your account.
Free trial, subscription and billing
New customers may receive a free trial of up to one month. After the trial, the service is billed monthly in advance, in US dollars, at the price of the plan you choose. Prices may change with at least 30 days' notice. Applicable taxes are added where required.
Cancellation and refunds
You can cancel at any time from your account or by contacting us. Cancellation takes effect at the end of the current billing period, and no further payments are taken. Payments already made are not refunded, except where required by law or in case of a prolonged outage caused by us.
Your data
The contacts, notes, call history and messages you store in Zorino remain your property. We process them only to provide the service, as described in our privacy policy. You can export your data at any time. After your account is closed, we delete your data within 30 days, except where the law requires us to keep it longer.
Google connection
Users can connect a Google account to import contacts in read-only mode. By connecting your account, you confirm that you are authorized to process these contacts and you accept our privacy policy.
Availability and liability
The application is provided "as is", with no guarantee of continuous availability. To the extent permitted by law, our total liability for any claim related to the service is limited to the amount you paid us in the three months before the claim. We are not responsible for indirect losses or for interruptions caused by Twilio, your telephone carrier or factors beyond our control.
Suspension
We may suspend an account in case of non-payment, abuse, illegal use or a risk to the service, after notifying you where reasonably possible.
Governing law
These terms are governed by the laws of the Province of Quebec and the federal laws of Canada applicable therein. Any dispute will be brought before the courts of the judicial district of Terrebonne, Quebec, unless the law requires otherwise.
